The competition

  1. These Terms and Conditions govern all competitions promoted and operated on the Promoter’s website at https://www.prizeharbour.com (the “Website”).
  2. Entry to a competition may be made by paying the applicable entry fee through the Promoter’s online entry process (the “Online Entry Route”). A free method of entry is also available by post as described in the ‘How to enter’ section below (the ‘Postal Entry Route’). Any individual who enters a competition using either the Online Entry Route or the Postal Entry Route shall be referred to as an “Entrant” for the purposes of these Terms and Conditions.

How to enter

  1. Each draw-based competition will be open from the date it appears on the Website (the “Published Date”) until the stated closing date and time (the “Closing Date”). All dates and times referred to in these Terms and Conditions are based on London, England time.
  2. Where it becomes strictly necessary due to circumstances outside the Promoter’s control, and where failing to do so would be unfair to Entrants who have already participated, the Promoter reserves the right to amend the Closing Date or rectify an incorrectly displayed Published Date. Any such changes will be updated on the Website and all affected Entrants will be informed by email.
  3. Entries must be submitted no earlier than the Published Date and no later than the time specified on the Closing Date. Entries received outside of this window may be deemed invalid and disqualified without refund. Entries received after the Closing Date will not be included in the relevant competition. However, where a valid Postal Entry is received within 72 hours after the Closing Date, the Entrant will be issued with a credit equal to the equivalent Online Entry Route fee, which may be used to enter an alternative competition or competitions on the Website via the Online Entry Route.
  4. To enter a competition using the Online Entry Route:
    1. Draw-Based Competitions
      • (1) go to the Website;
      • (2) select desired number of entries;
      • (3) complete the checkout process and submit the online entry form;
      • (4) complete the payment to receive your order confirmation.
    2. All submissions must be in English; entries in other languages will be disqualified without refund. Ensure your entry complies with this requirement to avoid disqualification and loss of fees.
    3. The Promoter will confirm receipt of your entry and, for draw-based contests, will email your assigned ticket number(s) to the registered email address. This ensures you are notified once your entry is successfully received and your ticket(s) allocated.
    4. The Promoter is not liable for incomplete, lost, or delayed entries, regardless of the reason. This includes issues caused by equipment failure, technical problems, or system malfunctions involving hardware, software, servers, or networks, which may prevent successful submission or processing of entries.
    5. Participating in the competition by submitting an entry, creating an account, or making a purchase signifies your agreement to these terms and conditions and your contractual commitment with the Promoter, binding you to the rules outlined.
  5. You can participate via the Postal Entry Route by following the specified conditions to enter the competition successfully.:
  1. Please submit your entry on an unsealed postcard via first or second class mail to the Promoter at the address provided: 167-169 Great Portland Street, 5th Floor, London, W1W 5PF, ensuring it is properly posted for consideration.;
  2. Include with your entry the following information:
    • (i) your full name;
    • (ii) your address;
    • (iii) a contact telephone number and email address; and
    • (iv) your chosen competition.
  3. Incomplete or illegible entries will be disqualified;
  4. Participants can submit multiple free entries for the competition, limited only by the Promoter’s specified maximum. Each free entry must be submitted individually and sent separately. Bulk submissions are not allowed; they will be treated as a single entry, regardless of the number of entries included. This ensures fair participation and accurate counting of entries;
  5. Participating in the competition confirms your eligibility and acceptance of the terms and conditions outlined for entry.;
  6. The Promoter will send an email to each valid postal entry participant, confirming their ticket number(s) for the Draw Based Competition, ensuring all entrants are properly notified of their entries.
  7. Participants must register an account on the website to qualify for free entry. All postcard details must match the account information to ensure receipt of confirmation and ticket number. Postal entries without a registered account cannot be processed. Additionally, entrants need to add an address to their account for their entries to be valid and processed successfully.

Choosing a winner and allocation of outcomes

  1. Draw Based Competitions
  1. All participants entering a draw-based competition as described in the ‘How to enter’ section will be randomly selected through a verifiable process. The draw will occur on the specified Closing Date, known as the Draw Date. The winner will be chosen fairly and transparently using this random selection method.
  2. In case the draw is interrupted or results are inconclusive, we reserve the right to conduct a new draw at our sole discretion, using the original method or an alternative process, to ensure fairness and proper outcome of the selection.
  1. For postal entries, the Promoter will register the entry on the Entrant’s account after receiving a valid submission. The Entrant can then view the results through their account dashboard, ensuring easy access to their entry status and outcomes.

  1. How draws are conducted
  1. Live draw results are considered valid and final if the tickets are selected without interruption. This process ensures the integrity and fairness of the draw, maintaining transparency and accuracy in the results.
  2. The random number draw will be performed using the random.org ‘Third-Party Draw Service’ algorithm to ensure a fair and unbiased selection process.

Eligibility

  1. Participation is open to individuals aged 18 or older residing in countries where entering the competition and awarding prizes is legal. The competition is subject to local laws, and the Promoter reserves the right to verify eligibility and compliance before awarding any prizes, ensuring lawful participation for all entrants, except:
  1. employees of the Promoter;
  2. employees of agents or suppliers of the Promoter, who are professionally connected with the competition or its administration; or
  3. members of the immediate families or households of (a) and (b) above.
  1. Participation in any competition confirms your eligibility and your right to claim any prize won. The Promoter may ask for proof of eligibility. If you do not provide the requested documentation or information within 21 days of the request, you risk disqualification. In such cases, an alternative winner may be chosen. Ensuring timely submission of proof is essential to maintain your eligibility and avoid disqualification from the competition.
  2. The Promoter will not accept competition entries that are:
  1. automatically generated by computer;
  2. submitted by agents, third parties or syndicated entries;
  3. incomplete.

4. The Promoter reserves all rights to disqualify you if:

  1. The Promoter has reasonable grounds to believe that you have contravened these terms and conditions;
  2. The Promoter has reasonable grounds to believe that you have collaborated with others (including individuals within your household) or have submitted entries falsely attributed to another person, with the intent to bypass these terms and conditions or violate any relevant laws or regulations;
  3. It is, or has become, unlawful for the Promoter to advertise the competition to you and/or to grant the Prize to you;
  4. If it is found that you are engaging in abusive behaviour or manipulating the operation of the prize competition, the Website, or entering through deceptive methods; or
  5. If it is determined that you have submitted an entry or comment on the Promoter’s Facebook page that the Promoter considers inappropriate, offensive, or distressing to other entrants or to the Promoter itself, or that violates any relevant laws, appropriate action may be taken.
  6. Refunds will be issued solely at the discretion of the Promoter and only under exceptional circumstances. Please note that entry fees are non-refundable:
    • (a) If, after submitting your entry into the competition, you discover that you are ineligible to participate or claim the Prize; or
    • (b) If the Promoter disqualifies you from the competition in accordance with these terms and conditions.
  1. Participants are allowed to submit entries for each competition multiple times, provided they do not exceed the specified maximum number of entries per individual or the overall limit for the competition.
  2. Only one account is permitted per household.

The prize

  1. Each competition may offer one or more prizes, which are detailed on the corresponding competition pages of the Website (referred to as the “Prizes”). The information regarding the Prizes is, to the best of the Promoter’s knowledge and belief, accurate as of the Opening Date of each competition.
  2. Non-cash Prizes are subject to availability. The Promoter retains the right to replace the prize with one of equal or greater value. In the event of any changes to the Prize details, the Promoter will make every effort to update the Website promptly.
  3. The Promoter disclaims any representations and warranties regarding the Prize, including its value, condition, or any information presented on the Website. Furthermore, the Promoter does not guarantee that the information provided on the Website is accurate, complete, or current.
  4. Additional conditions may apply to other non-cash prizes, and these will be specified on the respective competition page of the Website.
  5. The Prize may be supplied by a third-party supplier (the “Supplier”). Details of the Supplier (if any) will be provided on the Website.
  6. The Promoter retains the right to replace a Prize with an alternative cash prize (“Cash Prize”) under the following conditions:
    • (a) the Prize becomes unavailable;
    • (b) due to unforeseen circumstances outside the reasonable control of the Promoter, it has become necessary to proceed accordingly;
  1. The prize is not negotiable or transferable.
  2. The Winner is responsible for all costs and expenses not explicitly included with the Prize.

Winners

  1. The Promoter’s decision is final, and no further correspondence or discussions will be entertained.
  2. The full name of the winner will be disclosed during the live draw for Draw-Based Competitions. Following the Draw Date, the Promoter will reach out to the winner of a Draw-Based Competition personally at the earliest opportunity using the telephone number or email address provided in their competition entry. 
  3. The Promoter will make diligent efforts to reach the winner. If the winner cannot be contacted or fails to claim the Prize within 21 days following the Draw Date, the Promoter reserves the right to select an Alternate Winner. This Alternate Winner will be chosen randomly from the pool of remaining valid entries submitted before the Closing Date, using the same selection method as the original draw. The Alternate Winner will then have 21 days from the notification of their selection by the Promoter to confirm their acceptance of the Prize. This process will repeat until a winner successfully accepts the Prize.
  4. If a selected Winner is awarded a prize exceeding a value determined by the Promoter, they are required to supply valid proof of identity and address that corresponds with the details used during their registration with the Promoter in order to claim the Prize. Should the Winner fail to present this proof within 21 days of accepting the prize, the Promoter may undertake an independent investigation. If the Promoter is unable to verify the Winner’s identity within three months following the relevant draw, they reserve the right to award the Prize to an Alternate Winner.
  5. The Promoter is required to publish or provide information confirming that a valid award has occurred. To fulfil this requirement, the Promoter will disclose the full names of major prize winners on the Website, unless you object.
  6. If you have any objections to the publication or availability of your full name and winning entry, please reach out to the Promoter at help@prizeharbour.com before the Closing Date. However, in these cases, the Promoter is still obligated to provide this information to the Advertising Standards Authority upon request.

Claiming the prize

  1. You must personally claim the Prize; a third party cannot claim it for you. Information regarding how the Prize will be delivered to you or made available for collection can be found on the Website or can be requested.
  2. If your personal information, including contact details, changes at any time, you must inform the Promoter promptly. Notifications should be sent via email to hello@prizeharbour.com and must include your current and new details, along with the competition entered. If your details change within 10 days of the Closing Date, the Promoter may use your previous information to contact you if necessary. Timely updates are essential to ensure proper communication and eligibility.
  3. Any monetary prize will be directly deposited into the winner’s designated bank account. The winner must provide proof that they are the sole or joint account holder. Failure to submit this evidence within 21 days of accepting the prize will lead to disqualification, and the prize will be forfeited. In such cases, the Promoter reserves the right to award the prize to the next eligible entrant from the valid entries received before the deadline. This process ensures fairness and compliance with the competition rules.
  4. The Promoter does not accept any responsibility and is not liable to pay any compensation if you are unable to or do not take up the prize. 

Limitation of liability

If the Promoter fails to adhere to these terms and conditions, they are liable for any foreseeable loss or damage resulting from their breach or negligence. However, the Promoter is not responsible for damages that were not foreseeable. Loss or damage is considered foreseeable if it was an obvious consequence of the breach or if both parties contemplated it at the time of entering the competition. This limitation underscores the importance of understanding the scope of liability and the foreseeability of potential damages in contractual obligations related to the promotion.

Data protection and publicity

  1. Participation in the competition signifies your consent that any personal data you submit may be stored and utilized by the Promoter, its agents, or suppliers. This data will be used for administering the contest, managing prizes, and notifying you about future competitions and schedules, as outlined in the Promoter’s Privacy Policy. A copy of this policy is accessible on the official website. Your participation indicates acceptance of these terms and conditions.
  2. By submitting content, you agree that the Promoter may use it for promotional purposes. If you prefer not to participate in publicity, you must inform the Promoter. This choice will not impact your chances of winning the Prize. Even if you decline publicity participation, your details may still be shared with the Advertising Standards Authority, as required by law. This ensures the proper administration of the competition and the legitimacy of the Prize award, complying with legal obligations and maintaining transparency in the process.
  3. Under data protection regulations, you have the right to request that the Promoter refrains from contacting you and deletes your personal information from its database. Such a request will result in your withdrawal from the competition, as the Promoter will be unable to notify you if you are selected as a winner. Please note, withdrawing in this manner does not entitle you to a refund of any entry fee paid. If you prefer that your personal data is not used for promotional activities, you must contact the Promoter via email at hello@prizeharbour.com. Your cooperation ensures compliance with data protection laws and respects your privacy rights.

General

  1. The Promoter retains the right to modify these terms and conditions periodically. The most current version will always be accessible on the Website, ensuring participants are informed of any updates or changes. 
  2. If there is any suspicion of a violation of these terms and conditions, the Promoter reserves the right, at its sole discretion, to disqualify you from participating in the current competition and any future contests. This measure is taken to uphold the integrity of the competition process.
  3. The Promoter reserves the right to void, suspend, cancel, or modify the prize competition at any time if circumstances beyond its control make such actions necessary. In the event of cancellation, the Promoter will refund entry fees to each participant, either via bank transfer or cheque, with multiple entries by a single participant combined into one payment. Once refunds are issued, the Promoter bears no further liability to the Entrant or any other party. This policy ensures fairness and clarity in the event of unforeseen disruptions.
  4. The competitions hosted on this website are not sponsored, endorsed, managed, or affiliated with Meta, Apple, or Google. Participants acknowledge that these companies bear no responsibility or liability for the administration, conduct, or promotion of the contests. By entering, entrants accept these terms and conditions, releasing Meta, Apple, and Google from any related obligations.
  5. These terms and conditions are subject to English law. Each participant, as a consumer, retains the benefit of mandatory legal provisions from their country of residence. Nothing in these terms, including this clause, diminishes an Entrant’s rights under local law to rely on such mandatory protections. The intent is to ensure legal clarity and uphold consumer rights across jurisdictions.
  6. The courts of England and Wales shall have jurisdiction over disputes related to these terms and conditions. Nonetheless, an Entrant residing in an EU country may opt to initiate proceedings in the courts of their resident EU jurisdiction, maintaining the original intent with a formal, serious tone.
  7. Please print a copy of these terms and conditions for your records, and retain them for future reference.
